Washington is a true no-fault divorce state. This means you do not need to prove that your spouse did something wrong to file for divorce. Instead, one spouse simply states that the marriage is irretrievably broken. Unlike many other states, Washington does not allow couples to pursue an “at-fault” divorce based on allegations such as adultery, abuse, addiction, abandonment, bigamy, or mental illness.
Washington is also a community property state. Generally, any assets and debts acquired during the marriage are presumed to belong equally to both spouses, regardless of whose name is on the title or account. While certain exceptions may apply — such as inheritances or specific gifts — most property and liabilities accumulated during the marriage are subject to division by the court.
Additionally, Washington courts do not typically consider marital misconduct when dividing property or awarding spousal support. Many people assume that infidelity or other harmful behavior will automatically result in a larger share of assets or custody rights, but that is not necessarily how the law operates in this state.
