When Do You Need An Emergency Custody Order?
The moment you believe your child’s safety could be in jeopardy, it is time to file for an emergency custody order. Here are a few reasons why you may need to obtain an emergency custody order immediately:
- Abuse: If you have witnessed or have evidence of your child being abused by their parent, such as neglecting them, filing for an emergency custody order may be wise.
- Substance use: Having knowledge or evidence of the other parent using illegal substances while caring for the child also warrants legal action.
- Abduction: If you suspect the child’s other parent is planning to abduct them, securing an emergency custody order may be the only way to stop them.
When you have any notion that your child is not safe, seeking legal help to immediately be granted an emergency custody order is the best option for you and your child.

Are Emergency Custody Orders Permanent?
Emergency custody orders are only temporary and are meant to last until the return hearing. At the hearing, a judge will determine if a permanent parenting plan needs to be established to replace the temporary emergency custody order.

How Does An Emergency Custody Hearing In Everett Work?
After you have filed a petition to request an emergency custody hearing, your attorney will provide the available evidence to the judge. The emergency hearing will then occur, and the judge will decide whether to grant an emergency custody order. If the order is established, a return hearing will be scheduled. At the return hearing, the judge will give their final decision and possibly grant a permanent custody order.
